1. Acceptance of Terms
By downloading, accessing, or using GolfCartCompass, including GolfCartCompass.com and any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
These Terms form a legally binding agreement between you and GolfCartCompass (“we,” “us,” or “our”).
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian.
By using the Service, you represent that you have the legal capacity to enter into these Terms.
3. User Accounts
Some features may require an account. You are responsible for providing accurate information, protecting your login credentials, and all activity that occurs under your account.
You agree to notify us promptly if you believe your account has been accessed without authorization. We are not responsible for losses caused by your failure to secure your account.
4. License to Use the Service
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for lawful, noncommercial purposes.
You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, attempt to extract source code from, or create derivative works from the Service except where applicable law expressly permits such activity.
5. Navigation and Route Information
GolfCartCompass is intended to assist with golf-cart navigation and route discovery. Route guidance, road classifications, community paths, points of interest, closures, traffic conditions, and other information may be incomplete, delayed, inaccurate, unavailable, or unsuitable for your specific vehicle or circumstances.
You are solely responsible for evaluating whether a route is lawful, accessible, and safe. Always obey traffic laws, private-property restrictions, community rules, posted signs, law-enforcement instructions, and manufacturer guidance.
Do not rely on the Service in emergencies or where inaccurate information could result in death, personal injury, property damage, or other serious harm.
6. Safe Operation and User Responsibility
You are solely responsible for operating your golf cart safely. Do not interact with the Service in a manner that distracts you while driving. Use a passenger, stop in a safe location, or use hands-free features where lawful and appropriate.
You assume all risks associated with your use of routes, roads, trails, crossings, paths, neighborhoods, and destinations identified through the Service, including risks related to weather, terrain, traffic, construction, restricted access, vehicle limitations, and changing local conditions.
7. User Content
The Service may allow you to create, record, upload, submit, rate, review, save, or share routes, photos, comments, descriptions, and other materials (“User Content”). You retain ownership of your User Content.
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, adapt, publish, display, distribute, and use that content as needed to operate, improve, promote, and provide the Service.
You represent that you own or have the necessary rights to submit your User Content and that it does not violate any law, contract, privacy right, intellectual-property right, or other right of any person or entity.
8. Public and Private Routes
You may have options to designate routes or related content as public or private. Public content may be visible, copied, saved, rated, or used by other users. Do not include sensitive, confidential, or personally identifying information in public content.
Privacy settings reduce visibility but may not guarantee absolute confidentiality. You are responsible for reviewing your sharing settings before publishing content.
9. Prohibited Conduct
You agree not to:
- Use the Service for unlawful, fraudulent, harmful, or abusive purposes.
- Submit false, misleading, dangerous, defamatory, obscene, infringing, or malicious content.
- Encourage users to enter restricted areas, trespass, violate traffic laws, or use unsafe routes.
- Interfere with the Service, its security, servers, networks, or other users.
- Use automated systems to scrape, harvest, copy, or access the Service without permission.
- Impersonate another person or misrepresent your identity or affiliation.
- Upload malware, viruses, harmful code, or content designed to disrupt the Service.
- Use the Service to track another person without lawful authorization and consent.
10. Content Moderation
We may, but are not required to, monitor, review, remove, restrict, or disable access to User Content or accounts that we believe violate these Terms, create safety concerns, infringe rights, or harm the Service or its users.
We do not endorse or guarantee the accuracy, quality, legality, or safety of User Content.
11. GolfCartCompass Pro Subscriptions
Certain features may be offered through GolfCartCompass Pro, including monthly or annual auto-renewable subscriptions. Available features, prices, trial periods, and billing terms will be shown before purchase.
Subscriptions purchased through Apple are billed to your Apple ID account and automatically renew unless canceled before the end of the current subscription period. You can manage or cancel your subscription through your Apple account settings. Any refund requests are subject to the policies of the applicable app-store provider.
We may change subscription features or pricing in accordance with applicable law and app-store requirements. Changes will not affect an already-paid subscription period unless otherwise permitted.
12. Third-Party Services and Content
The Service may rely on or link to third-party maps, data providers, websites, payment systems, app stores, analytics services, or other services. We do not control and are not responsible for third-party content, availability, accuracy, security, privacy practices, or terms.
Your use of third-party services may be governed by separate agreements between you and those third parties.
13. Intellectual Property
The Service, including its software, design, branding, logos, text, graphics, features, and other content excluding User Content, is owned by or licensed to GolfCartCompass and is protected by intellectual-property laws.
No rights are granted to you except the limited right to use the Service under these Terms.
14. Feedback
If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use that feedback without restriction, compensation, or obligation to you.
15. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
16. Service Availability and Changes
We may add, modify, suspend, or discontinue any part of the Service at any time. We do not guarantee that the Service will always be available, uninterrupted, secure, error-free, or compatible with every device, operating system, location, or golf cart.
We may release updates that are required for continued use of the Service.
17. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR SAFETY.
WE DO NOT WARRANT THAT ROUTES, DIRECTIONS, COMMUNITY CONTENT, LOCATION DATA, ROAD INFORMATION, OR OTHER INFORMATION WILL BE ACCURATE, COMPLETE, CURRENT, LEGAL, ACCESSIBLE, OR SAFE.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLFCARTCOMPASS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, USE, PROPERTY, OR PERSONAL INJURY ARISING FROM OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO US DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR $100.
Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the above provisions may not apply to you.
19. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless GolfCartCompass and its owners, officers, employees, contractors, licensors, and service providers from claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any law or third-party right.
20. Suspension and Termination
You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe you violated these Terms, created a safety or security risk, exposed us or others to liability, or misused the Service.
Upon termination, your right to use the Service ends. Provisions that by their nature should survive termination will remain in effect, including ownership, disclaimers, liability limitations, indemnification, and dispute provisions.
21. Governing Law
These Terms are governed by the laws of the United States and, where applicable, the laws of the jurisdiction in which GolfCartCompass is headquartered, without regard to conflict of law principles.
Nothing in these Terms limits any rights you may have under mandatory consumer protection laws in your state, country, province, or other place of residence.
22. Apple-Specific Terms
If you downloaded the app through Apple’s App Store, you acknowledge that these Terms are between you and GolfCartCompass, not Apple. Apple is not responsible for the Service, its content, maintenance, support, warranties, or claims relating to the app.
Your license to use the app is limited to a non-transferable license to use it on Apple-branded products that you own or control, as permitted by applicable App Store usage rules. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you.
23. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Service after updated Terms become effective constitutes acceptance of the changes.
24. General Terms
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later.
You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.
These Terms, together with the Privacy Policy and any additional terms presented for specific features, constitute the entire agreement between you and GolfCartCompass regarding the Service.
